Privacy Policy
Last Updated: 2025
This Privacy Policy (“Policy”) describes how Swift Navigation, Inc. (“Swift,” “we,” “us,” or “our”) collects, uses, discloses, and protects “Personal Data” when you access or use our websites, including swift-nav.com, skylark.swiftnav.com, and any related pages or features (collectively, the “Site”). By accessing or using the Site, you agree to this Policy.
1. Scope of This Policy
This Policy applies only to Personal Data collected through the public Site. This Policy does not apply to data that Swift processes when providing its products or services to enterprise customers—including GNSS correction services, APIs, SDKs, device integrations, dashboards, logs, or telemetry. Such processing is governed exclusively by the applicable written agreement between Swift and the enterprise customer.
2. Relationship to Customer Agreements
If you or your organization have entered into a written agreement with Swift governing your use of Swift’s products or services (including any Master Services Agreement, Order Form, Data Processing Addendum, OEM or enterprise contract), then that agreement controls with respect to Personal Data processed in connection with such services. This Policy applies only to your use of the public-facing Site and does not modify, limit, or supersede any separate agreement you may have with Swift.
3. Definitions
“Personal Data” means any information relating to an identified or identifiable individual. “Processing” means any operation performed on Personal Data, including collection, storage, use, disclosure, transmission, or deletion. “Device Information” means IP address, browser type, operating system, and similar data. “Cookies” means small data files stored on your device for analytics or functionality.
4. Personal Data We Collect
We collect Personal Data you voluntarily submit, such as contact information, form submissions, newsletter sign-ups, or feedback (“Submissions”). Automatically collected data includes IP address, browser and device information, analytics data, and Cookie data. The public Site does not collect GNSS telemetry, correction-service logs, or embedded-device data; such data is governed by enterprise agreements.
5. How We Use Personal Data
We use Personal Data to respond to inquiries, provide marketing communications (with consent where required), analyze Site performance, conduct research, enhance security, and comply with legal obligations. We do not use Personal Data for automated decision-making that produces legal or similarly significant effects.
6. Legal Bases for Processing (GDPR)
Where GDPR applies, Swift processes Personal Data under the legal bases of consent, legitimate interests, contract, or legal obligation, depending on the context.
7. Cookies & Tracking Technologies
The Site uses Cookies and similar technologies for analytics, performance, and security. Where required by law, we obtain consent before setting non-essential Cookies. The Site does not currently respond to “Do Not Track” signals due to the absence of a recognized standard.
8. Sharing Personal Data
We may share Personal Data with service providers, professional advisors, regulators, or successors in a merger or acquisition. We do not sell or rent Personal Data. Third parties may process Personal Data only under confidentiality and data-protection obligations.
9. International Transfers
If you access the Site from outside the United States, your Personal Data may be transferred to and processed in the U.S. or other jurisdictions. Where required by GDPR, Swift uses mechanisms such as Standard Contractual Clauses (“SCCs”) to safeguard transfers.
10. Data Retention
We retain Personal Data only as long as necessary for the purposes described or as required by law. For example: contact submissions for 24–36 months, analytics data for 12–24 months, and security logs for 12–24 months. Data is deleted or anonymized thereafter.
11. Data Security
Swift implements reasonable technical and organizational measures, including encryption, access controls, and security monitoring. No method of transmission or storage is perfectly secure, and use of the Site involves inherent risk.
12. Your Privacy Rights
Depending on your jurisdiction, you may have rights to access, correct, delete, restrict, or object to Processing of Personal Data, withdraw consent, or request portability. California residents may request to know collected categories, request correction or deletion, and opt out of “sharing” (Swift does not “sell” or “share” Personal Data). Requests may be submitted to [email protected], subject to verification.
13. Children’s Privacy
The Site is not directed to children under age 13 (or the minimum age in your jurisdiction), and Swift does not knowingly collect Personal Data from children.
14. Automated Decision-Making
Swift does not use Personal Data collected through the Site for automated decision-making that produces legal or significant effects.
15. Accessibility
Swift strives to maintain an accessible website and welcomes feedback to improve accessibility.
16. Changes to This Policy
We may update this Policy from time to time. The “Last Updated” date will be revised accordingly. Continued use of the Site constitutes acceptance of the updated Policy.
